Terms of Service

These Terms of Service ("Terms") govern your use of the GymGate website and application, operated by Breukers Willem Albertus E.E. (Valaoritou 1, TK 10671, Athens, Greece). By creating an account, joining the waitlist, or using GymGate, you agree to these Terms.

1. The service

GymGatehelps you stay accountable to your gym routine by locking selected apps until your location confirms you have left for the gym, with a rest timer, session logging, streaks, characters, friends and leaderboards. App-locking relies on Apple Screen Time (Family Controls) on iOS, an accessibility-based blocker on Android, and your device's operating system. Features, availability and pricing may change.

2. Eligibility and accounts

You must be able to enter into a binding contract to purchase. Where you are a minor, you may use the service only as permitted by law and with the consent of the holder of parental responsibility. You are responsible for the information you provide, for keeping your login credentials secure, and for activity under your account. You may delete your account at any time in the app (Profile → Delete account).

3. Waitlist

Joining the waitlist registers your interest and reserves your place in the queue. It does not create any obligation to purchase, and we may change or discontinue the waitlist at any time.

4. Plans, payment and renewals

• GymGate Pro is a monthly subscription. The standard price is USD 6.99 per month. A founding Lifetime offer is a single one-time payment of USD 29.99 for lifetime Pro access, limited to the first 100 members while spots remain.
• Subscriptions renew automatically each month until cancelled. You can cancel or manage your subscription at any time through the in-app billing portal or, for purchases made through the App Store, in your Apple account settings; it remains active until the end of the paid period.
• Payments are processed by Stripe. Where you purchase through the Apple App Store, Apple's in-app purchase terms and billing apply.
• Prices are shown in US dollars and may be subject to applicable taxes. We may change prices for future purchases.

5. Right of withdrawal (consumers)

If you are a consumer in the EU, you normally have the right to withdraw from a distance contract within 14 days without giving a reason, under Directive 2011/83/EU as transposed into Greek law (J.M.D. Z1-891/2013). For digital content and services supplied immediately, you expressly request that performance begins during the withdrawal period and acknowledge that you lose the right of withdrawal once performance has begun with your consent. 6. Health and fitness disclaimer

GymGate is a motivation and accountability tool, not a medical or healthcare service, and does not provide medical, fitness or nutritional advice. Consult a qualified physician before beginning any exercise programme. You participate in physical activity at your own risk and are solely responsible for training safely; we are not liable for any injury or health consequence arising from your workouts.

7. App-locking

App-locking and the home-zone unlock depend on Apple Screen Time on iOS or Android's accessibility and screen-overlay permissions, together with your device settings and location services, and are provided on a best-effort basis. We do not guarantee that locking will be uninterrupted, error-free, or effective in preventing access to any particular app. An emergency unlock is always available to you, and you remain responsible for your own device usage.

8. User content and conduct

You are responsible for the username, display name and other content you provide, which may be visible to other users on leaderboards and in the friends feature. Do not use handles or content that are offensive, infringing, impersonating or unlawful. We may remove content or suspend accounts that breach these Terms.

9. Acceptable use

You agree not to misuse the service, including by attempting to gain unauthorised access, disrupt or overload our systems, circumvent security or anti-abuse measures, or use the service unlawfully. You must not manipulate sessions, stats or the leaderboard — for example by logging fake, automated or artificially short sessions to inflate points or rankings. We may void points, reset affected stats, or suspend accounts that do so.

10. Intellectual property

GymGate, its name, logo, characters and content are owned by us or our licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service for personal purposes.

11. Disclaimers and liability

The service is provided "as is", without warranties to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer-protection rights and liability for death, personal injury, fraud or gross negligence.

12. Termination

You may stop using the service or delete your account at any time. We may suspend or terminate access where you breach these Terms or where required by law.

13. Changes to these Terms

We may update these Terms. The effective date above reflects the latest version; continued use after changes constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of Greece. The competent courts of Athens have jurisdiction, without prejudice to any mandatory consumer rights to bring proceedings in your country of residence. EU consumers may also use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
